Sancionada una entidad con 5.000 euros por
registrar a un empresario como moroso


El Juzgado de Primera Instancia nº 2 de Benavente (Zamora) ha dictado sentencia  contra la entidad Pastor Servicios Financieros por el descrédito
mercantil ocasionado, de forma indebida, al industrial benaventano
E. B. M.

Pastor Servicios Financieros deberá pagar al empresario  la
cantidad de 5.000 euros por incluirle de una forma indebida en el registro de morosos.

Según indica el fallo de la sentencia del Juzgado de Primera Instancia número dos de Benavente, la cantidad es en concepto de daños y perjuicios por daño moral genérico como consecuencia de la intromisión ilegítima en su derecho al honor.
A A. R., un consumidor, que a su vez es empresario, se le exige judicialmente una
reclamación por parte de Pastor Servicios Financieros por un contrato de alarma
impagado. El usuario se opuso a desembolsar el dinero exigido a la entidad ya que elsistema no había funcionamiento correctamente y, además, ni esta persona, ni suempresa, había firmado ningún contrato de crédito con esta sociedad, sino con lacompañía de alarmas en cuestión.

 Pastor Servicios Financieros le incluyó en el Registro de Morosos ASNEF (Asociación Nacional de Entidades de Financiación).A. R., al considerar que la publicación de su nombre en dicho registro era una intromisión o vulneración de su derecho al honor al serle denegado un préstamo ICO de
liquidez, procedió a demandar a la entidad de crédito, con el resultado que hemos indicado.

Así pues, nuevamente, se corta el al uso coactivo y por las empresas de este tipo de ficheros de morosos.
